KEY DECISION TAKEN BY THE CABINET MEMBÅR FOR ADULT SOCIAL CARE Page 1 Forward Plan Reference: FP/014/0506 KEY DECISION TAKEN BY THE CABINET MEMBÅR FOR ADULT SOCIAL CARE Originating Officer: Steve Wilds Á Interim Operational Director (South) Thå transfer funding from BBW PCT to Essex County Cîuncil to finance the provision of contracts for social care and suppîrt services currently held by BBW PCT that will novate to Essex Cîunty Council as part of the Lead Commissioning arrangement. Decision båing made: to agree the transfer of approximately á9.7M pounds per annum under a section 28a agreemånt between BBW PCT, acting on behalf of the south Esseõ PCTÁs, and Essex County Council. The trànsfer will provide funding for residential care, suppîrted living, day care, advocacy and the provision of an låarning disability information database (TABBS). Backgrîund : Essex County Council has acted as the Lead Commissiîner for learning disability services since 2002 and in April 2006 renewed the Partnership Agreement with the PCTÁs in Esseõ until April 2009. Under the Leàrning Disability Partnership Agreement there is an eõpectation that ECC provides the management and strategic commissioning functiîn for health and social care services for people with a leàrning disability. As part of this function the County Council has alråady accepted the transfer of a number of social care servicå contracts and the funding associated with these cîntracts under section 28a agreements. These transfårs enable the County Council to use funding prîvided via health budgets, as a legacy from institutional mîdels of care, to continue to provide social care suppîrt for people with learning disabilities in line with the expectàtions of Valuing People. Scope of the transfer The trànsfer will include existing services provided in the independånt sector for 169 people in a mix of residential and supported living. The funding transferred will be approximately á9.72M per year, plus annual inflation. The section 28a agreemånts will be in place for 10 years and will cover the method of funding and the management of identified risks. At the end of the ten year påriod the section 28a will be reviewed by ECC and the PCT or successor bodies and either renewed for a further period or the services at the time fundåd through the section 28a would be transferred back to the råsponsibility of the PCT or successor body. GT/Key Decision APS 16.8.06 Page 2 The successful transfer of these servicås will complete the transfer of social care service from the Sîuth Essex PCTÁs to Essex County Counñil. Risk and benefit A risks and benefits analysis has been undertaken on the service within the transfer and it is cînsidered to be of greater benefit than risk to the County Council and the peîple who use its services. Under the agreement ECC will accept both the risk and benåfit of these services for the duration of the section 28a
